Terms of Use

These terms are an agreement between you and Randhawa Systems Inc. (“we,” “us”) for your use of the Larken app for iPhone and Apple Watch, the Larken keyboard and related services (together, “Larken”). By downloading or using Larken, you agree to these terms and to Apple's Licensed Application End User License Agreement (the “Apple EULA”). If these terms and the Apple EULA conflict, these terms apply to the extent the Apple EULA allows.

1. What Larken does

Larken turns your speech into written text. It records only when you tap the microphone, sends the recording to an AI provider for transcription and formatting, and returns the text to you. How we handle information is described in our Privacy Policy.

2. Subscriptions and free trial

Larken offers auto-renewing subscriptions: Your own key ($0.99 per month or $9.99 per year) and Full service ($9.99 per month or $99.99 per year), in US dollars. Prices in other countries are shown in the App Store. New subscribers get a 7-day free trial, available once per Apple ID across all Larken plans. Payment is charged to your Apple Account when you confirm purchase, or at the end of the free trial if you have one. Your subscription renews automatically at the same price and for the same period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple Account settings. If you cancel, you keep access until the end of the period you've paid for. Any unused part of a free trial is forfeited when you purchase a subscription. Refunds are handled by Apple under its policies.

3. Your own key

On the Your own key plan, you use your own OpenAI or ElevenLabs account. You're responsible for that account, its charges, and its terms. Larken doesn't control or pay for provider usage, and provider charges are separate from your Larken subscription. You're also responsible for keeping your key secure.

4. Full service fair use

Full service includes AI usage up to $5 per month and $1 per day, measured at our provider's list prices. When you reach the limit, new recordings pause until the allowance resets. We never charge overage fees. Recordings are limited to 5 minutes each. Short-lived access keys issued to your iPhone are for use only within Larken. We may suspend Full service for use that appears automated, shared, resold or abusive.

5. Acceptable use

You agree not to use Larken to break the law or anyone's rights, record people without any consent the law requires, create harmful or abusive content, or violate the usage policies of the AI providers Larken uses, including OpenAI's Usage Policies. You also agree not to reverse engineer, extract or misuse Larken's services or keys, or interfere with their operation.

6. Your content

What you say and the text Larken produces belong to you. You give us and our providers only the rights needed to process your recordings and return the text to you. We don't keep your recordings or text on our servers. AI-generated text can contain mistakes, so review it before you rely on or send it, especially for medical, legal, financial or other important matters.

7. Our rights

Larken, including its software, design and name, belongs to Randhawa Systems Inc. Subject to these terms and the Apple EULA, we give you a personal, non-transferable license to use Larken on Apple devices you own or control.

8. Third-party services

Larken relies on services from Apple, OpenAI, ElevenLabs and others that we don't control. We aren't responsible for their availability, accuracy or practices, and their terms apply to your use of them.

9. Changes and availability

We may update Larken, add or remove features, or change these terms. If a change to these terms is significant, we'll let you know in the app before it takes effect. Continuing to use Larken after that means you accept the updated terms. We may suspend or end access for anyone who breaks these terms.

10. Disclaimers

Larken is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Larken will be uninterrupted, error-free, or that transcriptions will be accurate.

11. Limitation of liability

To the fullest extent the law allows, Randhawa Systems Inc. won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Larken. Our total liability for any claim relating to Larken is limited to the amount you paid for Larken in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

12. Apple

These terms are between you and Randhawa Systems Inc., not Apple. Apple isn't responsible for Larken or its content, has no obligation to provide maintenance or support, and isn't responsible for any claims relating to Larken, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. General

These terms are governed by the laws of the jurisdiction in which Randhawa Systems Inc. is incorporated, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise. If any part of these terms can't be enforced, the rest stays in effect. If we don't enforce a term right away, that doesn't waive it.
